Your request for a waiver to use frequency 173.2625 MHz with an emission 11K2F3E and 3 watts ERP is denied and frequency 173.2625 MHz is removed from location 1. The waiver request does not meet rule 1.925(a)(3) because it does not list a specific rule, options to the waiver you have considered and it does not show you have no reasonable alternative. Frequency 173.2625 MHz is limited by rule 90.20(d)(32) and 90.20(d)(33). Rule 90.20(d)(32) limits the mobile frequency to 2 watts and rule 90.20(d)(33) limits the highest modulating frequency in Hertz and the amount of the frequency deviation or swing in Hertz may not exceed 2800 Hz and the maximum deviation may not exceed 2.5 kHz. Your request to use frequency 173.2625 MHz with an emission 11K2F3E does not explain if you considered other frequencies and what affect your emission and ERP increase will have on adjacent channels licensees. Your request for waiver to use frequency 173.2625 MHz does not meet rules 1.925, 90.20(d)(32) and 90.20(d)(33) and is therefore denied. Your application is granted in part pursuant to rule 1.945(e) and frequency 173.2625 MHz is removed from FCC File number 0006567411.

Beginning January 1, 2013, this station must operate on channels with a bandwidth of 12.5 kHz or less, or with equivalent efficiency, regardless of the emission bandwidths set forth on this license. See Section 90.209(b)(5) of the Commission's Rules. Note, however, that the narrowbanding requirement does not apply to specific channels designated in Rule 90.20 or 90.35 for paging only.
