This authorization is subject to the provisions set forth in Implementing a Nationwide, Broadband, Interoperable Public Safety Network in the 700 MHz Band; Development of Operational, Technical and Spectrum Requirements for Meeting Federal, State and Local Public Safety Communications Requirements Through the Year 2010, PS Docket No. 06-229, WT Docket No. 96-86, Second Report and Order, FCC 07-132 (rel. Aug. 10, 2007) (Second Report and Order), including but not limited to the prohibition against new narrowband operations in 764-767/794-797 MHz and 775-776/805-806 MHz bands as of August 30, 2007, as well as the requirement that, in order to be eligible for relocation reimbursement, narrowband mobile and portable handsets and base stations serving those handsets must be in operation as of August 30, 2007, as certified by the public safety licensee in accordance with the Second Report and Order. On or after August 30, 2007, any new narrowband equipment must be placed only in the consolidated narrowband 700 MHz blocks (769-775/799-805 MHz). Nothing in this authorization should be construed as granting any waiver or extension of any of the provisions, requirements, or prohibitions set forth in the Second Report and Order.

Operation in the 764 - 806 MHz frequency band must be operated only in accordance with Rule 90.545 and must protect existing TV and DTV broadcast stations transmitting on TV channels 62, 63, 64, 65, 67, 68, or 69.
