Special Temporary Authority is authorized on a secondary non-interference basis. This Special Temporary Authorization may be terminated at the Bureau's discretion, without a hearing, if conditions warrant. Under no circumstances may the facility(ies)authorized herein become a hazard to air navigation or violate the terms of an international agreement or treaty. Post and/or retain a copy of this authorization as required by the Commission's Rules. Operations under this Special Temporary Authorization must comply with the requirements of section 90.621(b) of the Commission's rules. Operation under this Special Temporary Authorization may not commence until the STA holder has established a process comparable to that outlined in paragraphs 133-139 of the Commission's Report and Order, Fifth Report and Order, Fourth Memorandum Opinion and Order, and Order in WT Docket No. 02-55 et al., FCC 04-168, released August 6, 2004, regarding 800 MHz rebanding, which provides for development of an electronic notification system for interference complaints, and that requires Sprint Nextel to respond to a complaint of interference from an existing licensee in the band within 24 hours and to resolve the complaint within 48 hours. This Special Temporary Authorization is subject to renewal, but in any event may not extend beyond the end of the 800 MHz rebanding process in the 800 MHz NPSPAC region covering the area where the STA is granted. Grant of this Special Temporary Authorization in no way serves to prejudice any action the Commission may decide to take in WT Docket No. 05-62.
