You are advised that this STA is issued without prejudice to any subsequent channel assignment that may be made in connection with reconfiguration of the 800 MHz band pursuant to Report & Order, FCC 04-168, released August 6, 2004 & Supplemental Order, FCC 04-294, released December 22, 2004. Further, grant of this STA does not establish precedence for the requested channels when the 800 MHz band is reconfigured -- you may be required to file an application for modification of license to specify frequencies other than those covered by this STA.  
It is the responsibility of the licensee to notify the TA of this action in order to be provided with replacement frequencies.  
The request for waiver of Rule 1.931(a)(3) has been denied. Rule 1.925 requires that waiver requests contain a complete explanation of why a waiver is required and demonstrate that the underlying purpose of the Rule would not be served or that there are unique or unusual circumstances, and no reasonable alternative. We have reviewed your request for waiver and determined that it does not satisfy Rule 1.925. The request fails to explain why the County cannot renew its STA at six month intervals and why such renewal is unduly burdensome. Additionally, the County failed to show how its situation is unique from the numerous other licensees that have operated under STA during rebanding. Further the Commission has recently announced an agreement with Mexico and will licensees should be moving forward with rebanding. The STA is renewed for 180 days.
